4.1 Contracting party and contact details
These terms are issued by Astralis Ltd. T/A Firefly Cinema, trading publicly as Firefly Cinemas NZ ("Firefly", "we", "us" or "our"). Website: https://fireflycinemas.co.nz/. Email: info@fireflycinemas.co.nz. Phone: +64 20 4064 4246.
4.2 Definitions
In these terms:
- "Customer" means a person acquiring a public ticket, pass, voucher, hire service or other service from Firefly.
- "Client" means a person or organisation booking a private, corporate, school, club, charity, community or equipment-hire service.
- "Event" includes a drive-in screening, outdoor screening, private screening, corporate event, fundraiser, AV hire or related activation.
- "Event listing" means the webpage, ticket page or written schedule describing a particular Event.
- "Independent Provider" means a venue, food truck, caterer, alcohol licensee, ticket agent, photographer, transport provider or other third party not supplying its product as Firefly's agent.
4.3 Scope and acceptance
These terms apply to use of the website and to bookings made directly with Firefly. A customer accepts the applicable terms by completing a booking, accepting a quote, signing an agreement, using a ticket or attending an Event after having a reasonable opportunity to review the terms.
4.4 Authority to book
The person making a booking confirms that they are at least 18 years old or have authority from an adult, and that they have authority to bind any organisation named in a quote. The booker must provide these terms and event rules to attendees, drivers, staff and contractors under their control.
4.5 Consumers and business customers
Consumer rights under the Consumer Guarantees Act and Fair Trading Act apply where the legal requirements are met. Firefly does not contract out of those rights for consumer purchases.
4.6 Order of documents
For a particular booking, the following order applies if there is a genuine inconsistency: (1) a signed agreement or accepted quote; (2) event-specific terms prominently disclosed before booking; (3) the Event listing; (4) general terms. A lower-priority document cannot remove a mandatory legal right.
4.7 Website use
The website may be used for lawful personal or business enquiries and bookings. Users must not interfere with security, introduce malicious code, scrape or overload the site, impersonate another person, attempt unauthorised access, copy protected content beyond lawful use or use the site for fraudulent bookings.
4.8 Accounts and customer information
Customers must provide accurate and current information and promptly update Firefly where a material detail changes. Firefly may rely on communications sent to the email address or phone number supplied.
4.9 Prices, GST and fees
Consumer prices will be presented in New Zealand dollars and inclusive of GST where Firefly is required to charge it. Compulsory booking or payment fees will be disclosed before purchase. Business quotes may state prices exclusive of GST.
4.10 Payment through Stripe
Firefly uses Stripe as the payment processor for online card transactions. Card details are entered into and processed through Stripe's secure payment environment. Firefly does not store full card numbers on its servers.
4.11 Booking confirmation
A booking is confirmed only when Firefly sends a confirmation email or accepts a signed quote or agreement.
4.12 Public tickets, credits, passes and vouchers
Public tickets, Event Credits, season passes and purchased gift vouchers are non-transferable for commercial resale. Event-specific vehicle and admission rules are part of the booking contract.
4.13 Private and corporate quotes
A quote is valid for the period stated and is based on the information supplied. Dates and equipment are held only when a deposit has been received.
4.14 Changes requested by the client
A client-requested change to date, venue, title, audience, capacity, admission price, equipment, programme or access times may require a revised quote or new licensing arrangements.
4.15 Cancellations, credits and refunds
If an event is cancelled by Firefly without a rain date, attendees receive a 100% refund or credit in accordance with our Weather Policy and NZ Consumer Guarantees Act.
4.16 Weather and force majeure
Public weather decisions are governed by our Kiwi Weather Guarantee. Neither party is excused from obligations that can still reasonably be performed.
4.17 Film availability and licensing
Film public performance licensing is strictly secured in accordance with our Public Performance Licensing Policy.
4.18 Venue rules and third-party venues
Attendees and clients must follow lawful venue rules, permit conditions and staff directions at all times.
4.19 Vehicle and pedestrian safety
Drivers must obey marshals, travel strictly at walking pace (maximum 5 km/h), keep a safe distance, use headlights only as directed, and park in their allocated bay.
4.20 Headlights, engines and vehicle positioning
Headlights, daytime running lights and interior lights must be switched off once parked. Vehicle engines must be switched off during the feature film.
4.21 FM audio and radio spectrum
Audio is broadcast on a dedicated FM frequency licensed under Radio Spectrum Management NZ guidelines.
4.22 Vehicle batteries and customer equipment
Customers are responsible for their vehicle battery condition. Free jump-pack assistance is available from our ground crew at the conclusion of every screening.
4.23 Prohibited conduct
Dangerous driving, burnouts, horns, abusive language, weapons, fireworks, open flames, and unauthorized commercial solicitation are strictly prohibited.
4.24 Smoking, vaping and fire safety
Firefly Cinemas is strictly a smoke-free and vape-free venue. Open flames and personal cooking equipment are prohibited.
4.25 Alcohol
Unless expressly advertised as a licensed event, Firefly public drive-in screenings are strictly alcohol-free.
4.26 Food, drinks and independent vendors
Attendees may bring their own snacks or purchase from our rotating Food Truck Village. Allergens must be checked directly with food vendors.
4.27 Animals
Certified assistance dogs are always welcome. Other domestic pets must remain inside your vehicle at all times and must not cause disturbance.
4.28 Children and supervision
Children must be supervised by a responsible adult at all times, especially when moving between vehicles and food trucks.
4.29 Accessibility
We provide accessible parking and sightline allocations. Please notify staff upon entry so we can marshal your vehicle appropriately.
4.30 Photography and event recording
Firefly may take wide crowd photographs for archival and promotional use. Attendees wishing to opt out may notify ground marshals.
4.31 Customer property
Firefly is not liable for theft or loss of personal property left inside unattended vehicles.
4.32 Website and Firefly intellectual property
All brand graphics, custom typography, and web content are copyright © Firefly Cinemas NZ.
4.33 Client-supplied content and indemnity
Clients booking private screenings warrant that all supplied media (slides, logos, videos) has been legally cleared for public display.
4.34 Liability and mandatory rights
Nothing in these terms limits rights under the NZ Consumer Guarantees Act 1993 or Fair Trading Act 1986.
4.35 Complaints and dispute resolution
Please send any concerns to info@fireflycinemas.co.nz with your booking reference. We investigate all enquiries in good faith.
4.36 Governing law and jurisdiction
These terms are governed by New Zealand law and subject to the exclusive jurisdiction of the New Zealand courts.
4.37 Changes to terms
Firefly may update these terms periodically. The version accepted at the time of your ticket booking applies to that screening.
4.38 Severability, waiver and assignment
If any clause is determined to be unenforceable, the remainder of these terms remains in full legal effect.
